海南自貿區負面清單出臺

海南自貿港跨境服務貿易負面清單三季度發佈，這將是國內首個跨境服務貿易負面清單。海南產業發展的重點是服務業，其服務業開放水準更高、限制更少。近年來，我國服務貿易規模不斷擴大，2012年我國服務貿易的總體規模位居世界第三，2014年達到世界第二。2016年，我國出臺服務貿易創新發展試點政策，2018年進一步擴大範圍，到2020年共經歷了三輪擴圍。對此，中國服務外包研究中心主任邢厚媛表示，海南自貿港跨境服務貿易負面清單的出臺，有利於海南服務業開放水準的提高，助力海南打造更高水準的開放高地。

1月，商務部新聞發言人高峰表示，商務部積極推進海南自由貿易港跨境服務貿易負面清單相關工作。2月，商務部自貿區港司相關負責人表示，商務部正會同有關部門推進出臺海南自由貿易港跨境服務貿易負面清單。今年全國兩會期間，商務部部長王文濤表示，商務部正著手制定跨境服務貿易負面清單。3月，商務部印發的《關於圍繞構建新發展格局做好穩外資工作的通知》中提出，制定自由貿易試驗區跨境服務貿易負面清單，形成更多制度創新成果向全國複製推廣。6月，高峰在商務部例行發佈會上表示，推動出臺海南自由貿易港跨境服務貿易負面清單。

檔列出的措施共70條，其中金融業中提到未經中國銀行監督管理機構批准，境外服務提供者不得以跨境交付方式從事銀行業金融機構、金融資產管理公司、信託公司、財務公司、金融租賃公司、消費金融公司、汽車金融公司，以及經中國銀行監督管理機構批准設立的其他金融機構的業務活動。

商務部提到，境外服務提供者不得以跨境方式提供負面清單中禁止的服務；以跨境方式提供清單中非禁止性領域服務，未列出的與國家安全、公共秩序、金融審慎、社會服務、人類遺傳資源、人文社科研發、文化新業態、航空業務權、移民和就業措施以及政府行使職能等相關措施，按照現行規定執行。

自貿港和自貿試驗區的負面清單可以走在前面，清單可以更短一些，體現更大力度的開放。未來要從全國整體的角度來統籌不同地區的跨境服務貿易負面清單之間的關係。不同的負面清單容易引起混淆，因此，跨境服務貿易負面清單的制定不宜過多，不能讓外界混淆。
